Matthias — sophomore slump for sure. Although the best episode of the whole season (in my opinion)was last Monday's “Four Months Ago…” (11/12) and we won't have the detailed data for that airing until tomorrow, but it still won't be anywhere near the levels of the premiere.

It's not a “sophomore slump,” a lawsuit filed by two nyc artists in a nyc federal court in march 2007 against Tim Kring and NBC for copyright infringement is having a chilling effect on Heroes storylines and it's ratings.
The judge on this lawsuit is Denise Cote.
Judge Cote tried Tyco executive Dennis Koslowski, he was sentenced to 25 years in prison in early 2007.

I think the ratings are worse because the show hasn't been very good this year. I'd attribute that more to Kring trying to write story arcs around NBC's scheduling and it not producing a good result.
That some set-designer asserts that Kring based the character Isaac on a real life artist — so what? Isaac was killed off last year. 99.999% of the people who have ever watched Heroes have never even heard of Joann Vara and a fair chunk of them seemingly stopped watching anyway.
I'm not saying that the storyline sucks isn't a result of legal action — there's no way for me to know for sure and I seriously doubt Mr. Kring will submit to a polygraph test so I can validate my theory that the show's writing wasn't affected by a lawsuit. But as for the ratings, the show just hasn't been as good this year.
Comparing Kring to Koslowski is beyond ludicrous in my not so humble opinion.

He claims he took a long walk with Jeph loeb and everything he pitched to jeph,
jeph told him”tim it's been done before”.
Tim pressed his eyes tight and presto! he was able to come up with a new show idea.
Tim's new idea made Jeph say: Tim, “the artist that can paint the future “,that's never been done before.
Tim called Jeph back after their long walk and asked,
“Jeph do you know of any artist that can paint?
Jeph pointed Tim kring to
Tim Sales, a comic book artist that couldn't paint, was color blind and needed to refer to a “Goya art book” for artistic inspiration on how to create paintings for a artist that can paint the future on a major network.( this is white affirmative action, because i doubt if a Black or Latino artist could get a job on a major network without having any qualifications , skills or real talent). Tim Kring went on to put a script together and add art to the script, something that is not done in Hollywood.
In interviews, all of the actors on Heroes said they were “shocked “to see art with a script and because of this fact they knew the show was going to be very special.
Tim Kring claims he pitched that script with art to NBC and on the strength of the script with art, NBC bought Heroes.
Tim's boss at NBC katherine Pope stated in an interview that” Tim's script with art was revolitionary and his writing skills were extraordinary.”( then why is Heroes number 30 in the ratings?).

A quick glance at the lawsuit files clearly shows the cover of Tim's script with art looks just like “The Twins' script with art. ( both are online).
A artist that can paint the future is a common stock element. what a writer adds to that common stock element is called an 'expression”. That expression is copyrightable.

the other chracters are common stock element that can be found in any superhero comic book. but no writer has developed a full character storyline for a ” artist that can paint the future” for a major network.

That's not the case with the other characters on Heroes. In fact Tim Kring is making every attempt to tell us about every Hero on the show except Isaac.
It doesn't matter what joann or any poster think, it's about the facts and what's in the lawsuit files on both sides. i have read both and i'm working on a documentary about this heinous crime. Tim kring lied to and duped a lot of people into thinking he's something he's not and I think the ratings and storylines reflect the level of his talent inspite of any network schedules or lawsuits. Tim Kring is on line for the writer's strike marching for the rights to get top dollar for the work he steals. well for hardworking production people that have to feed their families knowing the truth about this thief hack writer would be a hard pill to swallow. The man is scum and you're not feeling his crime because he's not a young Black male with a gun in his hand stealing your personal belongings.
You would want that Black man too submit to more than a polygraph, you'd want him in jail where he would rightfully belong.
It is not up to Tim Kring if “he will or want “to submit to a polygraph, it's up to the judge.

Here's something I found on “The Twins” artwork spoken about in the NY DailyNews.
“The Twins” painted and copyrighted a painting called “The Atta Page” in early 2001.
They left Texas in Jan 2001 enroute to NYC to use “The Atta Page” to stop 9-11-01 before it happened.
The Atta Page according to what's been posted online, is a large oil canvas that depicts” two airplanes crashing into the twin towers, with the message “a man named ATTA attack twin towers September 11 at 9:00 am.
The Atta Page also depicts the message that there are 9 letters in the word Manhattan and 11 letters in the name Mohamed Atta.
The name ATTA is also in the word manhATTAn.
note: Mohamed Atta was the first pilot to crash a stolen airplane into the twin towers on september 11, 2001.
according to a screening held at a college for “The Twins”, these artists claim that ATTA WAS SENT because whenever the world looks at the word manhATTAn, the world will always remember the name ATTA and what he did to the twin towers on SEPTEMBER 11,2001.
Now Robert did you see any of this? I didn't, not until i read the comments online.

The Twins not only paint on large canvas, but according to comments online they exhibit their work at major NYC galleries and their art and 9-11-01 story is part of the NY Historical Society's archives, under “CityLore” curated by Sally Herships.
A story was written in the Boston Globe newspaper about Sally Herships and her experience with “The Twins”.
There is another article in the Hunter college newspaper “The Envoy” date: May 11, 2005 where “The Twins” predicted and painted Hurricane” Katrina and Rita” that hit in August 2005.

The Twins not only paint on large canvas, but according to comments online they exhibit their work at major NYC galleries and their art and 9-11-01 story is part of the NY Historical Society’s archives, under “CityLore” curated by Sally Herships.
A story was written in the Boston Globe newspaper about Sally Herships and her experience with “The Twins”.
There is another article in the Hunter college newspaper “The Envoy” date: May 11, 2005 where “The Twins” predicted and painted Hurricane” Katrina and Rita” that hit in August 2005.

Wow, Poli certainly has investigated Tim Kring, good luck on your documentary. It's too bad Mr. Kring didn't steal, allegedly, more ideas when he created Heroes, because he certainly hasn't managed to keep up the creativity on his show. The first volume started out good but then became inconsistent and ended on a weak note. And the second volume has been a joke. Almost all the main characters just to repeat themselves in volume two learning nothing from their mistakes, Peter struggled to figure out what was happening to him, Claire rebelled against HRG, Nikki struggled with her alter ego, etc etc but they were now in different locations. Boring! And the new characters that were brought in only succeeded in weakening the show with their useless and repetitive side stories which dragged the pace down and did not give the kind of momentum needed to push a main storyline of such magnitude. Based on what we have gotten so far from Kring and his staff there really isn't any need to watch Volume III. Time Kring is the master of Illusion not a good story teller. He creates the most amazing hype every week for Heroes but the episodes end up to be duds, more often than not. Kring should spend less time using other people's ideas, allegedly…and coming up with cool catch phrases like, “Save the Cheerleader” to hook in loyal viewers. Then he could spend more time on the actual writing that goes into each episode. Because there's just no point enticing the viewer if you aren't going to deliver a quality product, they won't stay around.

I'm sorry. I have to say something here. Seasoned lurker that I am, I mostly glance at what people write online about shows and novels, as I am a writer of both. Kring, in all probability, did nothing wrong. An idea like “a painter who paints the future” is not only already “in the air” in an era of television shows, films, and books about psychics and dreamers and even people who can create a reality by painting or drawing or dreaming it, such an idea is already present in prior projects. The fact that these two think they came up with it on their own, prior to Kring or not, just proves that they don't read enough to have noticed how many variations of that story already exist. Next thing you know, they'll be claiming to have invented the vampire with a guilty conscience or the corrupt politician who is defeated at the last second just before he destroys the world. No offense intended here but the lawsuit, the accusations, the whole deal is not a “cause” worthy of anyone's attention. Kring is no genius but he is no criminal either and while the decline in the quality of the show may be, in part, due to the stress of the suit, it is far more likely that this decline is due to Kring's desire to branch out and include new characters that no one cares about. Also, as per Crossing Jordan, Kring has never been very good at developing the really evil characters who are made interesting to the viewer not by adding lots of people for them to kill but by illustrating the tendency for the bad among us to walk the line between the darkness and that glimmer of light and hope waiting to redeem them if only they would let it. The show really doesn't have anywhere to go as long as it's characters behave in a schizophrenic fashion, changing their personalities to suit whatever storyline Kring feels like trying out next. If you need someone to worry about, leave the court-loving nutters behind and concentrate of the environment or puppies or something. Everybody loves puppies.

POLI, I would recommend that you spend some of that babysitting money on law school so that you can actually put together a basis for an argument that's valid instead of spewing off non-sense.
The concept of a “painter who paints the future” is not able to be copyrighted. If Tim or anyone else wants to make a show about it, they can do so, and they can do it legally. If Tim wants to create a show about a group of 6 friends living in NYC together (”Friends”), a group of buddies and the bar they frequent (”Cheers”), a crime scene drama that uses evidence in-depth (CSI), etc…he can do so. Is it original? YES, IT IS. He's creating his own characters, own relationships, own story lines that evolve, etc. That's the originality, and it's not copyright infringement.
OH, wait…OMG! OMG! ABC made a drama about the doctors that work at a hospital and their relationships and lives trials (”Grey's Anatomy”). The creators of E.R. should sue! Oh wait…THEY CAN'T.
I guess in your eyes every pop star is violating copyright law and “stealing others work” when they sing about their failed relationships or the love of their life, or every country star is making money off another when they sing about drinking and their wives leaving them, or every rapper is a “thief” for singing about money, women, etc.
Get a grip and get a clue. If anyone is trying to make money off others, it's people like you trying to make documentaries about people and things you have/had no involvement in, trying to bank off the popularity of the show for your own personal interest and gain.
